What.....! Did you draft your patent by yourself ? No, I can't believe...it's impossible..
Yes, this will be the reaction of a person who is from either lower / local college graduate or may be someone else like me 😃.
No exaggeration till I draft my own patent, I was also one among them.
Don't worry let's together learn and draft our own patent now..
According to my experience I would like to divide drafting of patent in 5 steps :
Step 1 : Choose appropriate patent articles related to your work ( atleast upto 5 articles)
Step 2: Thoroughly study those selected articles and mark the important points that you feel to write
Step 3: Start writting in a chronological order i.e., from abstract to claims or summary.
Step 4: After finishings the content, learn how to draw patent drawing through online course like Udemy, course era or YouTube videos and implement it in your work
Step 5: Finally Claims : Write very important points describing about your work specialization, drawings and invention. For Indian patent upto 9 claims no charges are applied. Beyond it costs
Now after drafting a patent , along with your supervisor permission (if applicable) follow the steps to file an Indian patent.
1. Acquire a digital signature certificate (DSC) from any government agencies. This can be applied through online mode. It costs between Rs. 800/- to 3000/-. They will provide you a PDF document along with a pendrive.
2. Once after DSC, go to ipindia gov.in/patent website.
3. To your right side, choose the option online patent filling
4. Fill up the formal details carefully
5. In the end, out many Forms, you have to select appropriate forms related to your work.
Example :
For registration, need to select Form 1. It costs Rs. 1600/- and this form is mandatory
Form 9. For early publication request we need to fill this form
Likewise, different forms has to be selected related to type of your application and each form has its own cost. Overall to file an Indian patent with all forms it would completely costs around Rs. 20,000/-.
Important Note : You need to apply patent once after you got a clearance in patent search. To search for free, go to this link : https://ipindiaservices.gov.in/publicsearch
